Terms and Conditions
Version 1.3 — effective as of October 10, 2026
These Terms and Conditions govern the use of the site https://cheshirekat.com.ar (the "Site") and the purchase of licenses for the applications offered on it (the "Apps"). By creating an account, activating a trial or making a purchase, you accept these Terms, the Privacy Policy, the End User License Agreement (EULA) and the Withdrawal, Cancellations and Refunds Policy.
1. Who offers the service
The Site and the Apps are offered by Eduardo Daniel Vázquez, CUIT (Argentine tax ID) 20-12766543-6, domiciled at Viamonte 611, piso 4°, depto. "A", Ciudad Autónoma de Buenos Aires, Argentina (the "Owner"). Contact email: evazquez@amcisys.com.ar. You can also get in touch through the contact form.
2. What is offered
CheshireKat sells licenses to use Apps for the Linux desktop. The Apps are downloaded from the downloads page or from the Owner's official repositories. The purchase does not transfer ownership of the software: it grants a license to use it under the terms of the EULA.
The features, technical requirements and status of each App (available, beta or coming soon) are stated on its product page. Apps with "coming soon" status cannot be tried or purchased.
3. User account
- An account with a verified email address is required to activate a trial or make a purchase.
- To enter into a contract you must be of legal age and have the legal capacity to do so.
- You are responsible for keeping your password confidential and for the activity on your account. If you detect any unauthorized use, notify us immediately.
- The information you provide must be truthful. The processing of that information is described in the Privacy Policy.
4. Free trial
- Each available App can be tried for free for 30 days, on one (1) device, without a credit card and with no obligation to purchase.
- The trial can be used only once per account and per App.
- When the trial ends, the App stops working with all its features until a license is purchased. Nothing is ever charged automatically when the trial ends.
5. License types
All Apps are offered under the same license types, on their own or in a bundle (5.4):
5.1 One-time payment
- You pay only once and the license does not expire.
- It includes the version current on the purchase date, previous versions and program updates released during the 12 months following the purchase. Versions released after that period are not included: the license keeps working with no time limit with the latest covered version, and to receive the new ones you can switch to the subscription option.
- In the case of CheshireKat Antivirus, updates to the virus signature databases are not part of the one-time payment: they are a separate service, the signature database subscription, which is purchased from "My account" for each one-time payment license, is charged monthly according to the number of devices on that license and is cancelled like any other subscription (5.2). It includes the updates to the scanning engine that are essential to keep using the new databases. Without that subscription, the App keeps protecting with the latest signature database installed.
5.2 Monthly subscription
-
It is charged monthly in advance, by automatic debit through Mercado Pago, until you cancel it. The peso amount of each debit is calculated as explained in clause 6.
-
While it is active, it includes all updates released.
-
It can be cancelled at any time, without penalty and without having to give a reason:
- from "My account", or
- with the SERVICE CANCELLATION BUTTON, without needing to sign in.
Cancellation stops future charges, and the license keeps working until the end of the period already paid.
-
If a monthly charge is not credited, the license keeps working for 3 more days. After that period, it stops working until the payment is settled.
5.3 Number of devices
Each license is purchased for a number of devices: 1, 3, 5 or 10. For more than 10 devices, request a quote through the contact form.
From "My account" you can see the activated devices and release any of them, for example when changing computers. Releasing a device is free of charge and unlimited.
5.4 Bundles
- Two or more Apps can be purchased together, with the same license type and the same number of devices, with a discount on the sum of their prices: 10 % for two Apps, 15 % for three Apps and 20 % for the full Suite. The bundle price is rounded down.
- Each App in the bundle receives its own license, under the same conditions as if it were purchased alone.
- A subscription bundle is charged in a single monthly debit and is cancelled as a whole.
- The signature database subscription (5.1) is not part of bundles.
6. Prices and payment method
- Prices are published on the pricing page in US dollars (USD) and are final prices with taxes included.
- They are paid in Argentine pesos (ARS), converted at the MEP dollar (selling) rate in effect on the day of payment, which the Site displays with its date. The conversion is truncated to the unit: the cents always remain in your favor. Before payment, the Site shows the exact amount in pesos that will be charged; if the rate changes while you are choosing, it is shown to you again before charging.
- Payment is processed by Mercado Pago, with the payment methods that platform offers at the time of purchase. The Owner does not receive or store your card details. Any charges, installments or interest that Mercado Pago or the issuer of your payment method may apply are governed by their own terms.
- For subscriptions, the price in dollars stays fixed. The peso amount of each debit is recalculated on the day before the debit using the MEP dollar rate in effect, so it may vary from month to month according to that rate. If the dollar price of a subscription changes, you will be notified by email at least 30 days in advance, and you may cancel it before the change takes effect.
- The Owner will issue the corresponding tax receipt in accordance with current regulations.
7. Delivery
The license is delivered digitally. As soon as Mercado Pago confirms the payment, the license key appears in "My account" (in a bundle, one key per App). If the payment is pending crediting, the license is issued when it is credited.
8. Right of withdrawal
You may revoke the purchase within 10 calendar days from the date you made it, without any liability and without giving reasons (Consumer Protection Law, Ley 24.240, art. 34, and Civil and Commercial Code (Código Civil y Comercial), arts. 1110 et seq.). You can do so with the WITHDRAWAL BUTTON, available on every page of the Site, without registering or signing in.
Exception: under art. 1116 of the Código Civil y Comercial, the right of withdrawal does not apply once the license has been activated on any device. From that moment on, the software has been enabled for permanent use. The date of the first activation is recorded, and releasing the device afterwards does not cancel it. This exception is disclosed and accepted before payment. To evaluate the App before buying it, the 30-day free trial is available.
If the license has not been activated, the full amount paid is refunded and the license is revoked.
Bundles: the exception applies App by App. The part of the price corresponding to the Apps that have not been activated is refunded, in proportion to the amount actually charged according to the list price of each one, and only those licenses are revoked. Apps already activated keep their license and the bundle price; if it was a subscription, subsequent debits are reduced to those Apps.
Signature database subscription: the databases for each period are delivered as soon as the payment is credited. If you withdraw, the subscription is cancelled immediately, with no refund of what has already been paid, and the databases keep being updated until the end of the period paid. The one-time payment license does not change.
The procedure and time limits are set out in the Withdrawal, Cancellations and Refunds Policy.
9. Proper use
You agree not to:
- share, sell, publish or assign your license keys;
- circumvent or alter the license or activation mechanisms;
- use the Site for unlawful activities;
- attempt to gain unauthorized access to the systems of the Owner or of other users;
- intentionally overload the Site or its API.
Use of the Apps is also governed by the EULA.
10. Suspension and revocation
The Owner may revoke a license, after notice by email, in the following cases:
- chargeback or disputed payment;
- refund, including the exercise of the right of withdrawal;
- fraudulent use, or serious breach of these Terms or of the EULA.
If you consider the measure to be incorrect, you may request its review through the contact form.
11. Warranties and liability
- The Owner provides the service with diligence and corrects the defects reported to it within reasonable time frames.
- Nothing in these Terms limits the rights granted to you as a consumer by Consumer Protection Law Ley 24.240 and the Código Civil y Comercial, nor the applicable legal warranties. Any clause that contradicts those rights shall be deemed not written.
- Outside those rights and to the extent permitted by law, the Owner is not liable for indirect damages arising from:
- uses of the Apps other than those intended;
- failures of third-party devices, operating systems or services;
- data loss that could have been avoided with reasonable backups.
12. Site availability
The Owner strives to keep the Site, the license API and the repositories available at all times. There may be interruptions due to maintenance or to causes beyond its control.
The Apps can work offline for up to 7 days from the last license validation. This way, a brief interruption does not affect their use.
13. Changes
The Owner may update these Terms. The version and effective date appear at the beginning of the document. Changes are announced on the Site and, if they affect an ongoing contract, also by email.
Changes do not apply to purchases already made, unless they are in your favor.
14. Consumer service and complaints
- Inquiries and complaints: evazquez@amcisys.com.ar or the contact form.
- You may also file a complaint with the enforcement authority: Consumer protection (Argentina). For complaints, click here.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic. For any dispute, the consumer may bring proceedings before the courts of their own domicile (Código Civil y Comercial, art. 2654).
